Terms of Business (updated 20th August 2019)
Post-delivery support is limited to initial goods-in/inspection acceptance, prior to any subsequent customer/end user processing operations.
Purchasing Terms and Conditions
The following terms and conditions apply to all Protocon Engineering Purchase Orders & Quotations;
- All orders must be carried out to the requirements and specifications stated
- Free Issue parts cannot be replaced from any other source
- Orders must not be Sub Contracted to a third party without prior consent
- Plated parts must not be re-worked without prior consent
- Incoming release certificates must state order requirements in full
- Batches must be kept separate where stipulated
- Unless otherwise stated, all Sub Contract processes must be processed to the latest version of the standard
- If no mention of International Traffic in arms Regulations (ITAR) Export Administration Regulations (EAR) appears on the order confirmation, Protocon Engineering Ltd assume the products ordered are not affected by ITAR/EAR Regulations. It is the responsibility of the Customer/Supplier to advise Protocon Engineering Ltd if the product being ordered is subject to ITAR/EAR Regulations, and the implications regarding processing of the parts ordered.
- Acceptance of orders confirms suppliers will not disclose any information to any third party without the prior written consent of Protocon Engineering Ltd.
- Please be advised that rejects raised, where the liability is considered to be that of the named supplier will incur a £ 250 + VAT administration fee.
Items not complying to the above will be rejected
In addition to this :
- All supporting documentation must be returned on completion of order
- Any scrapped items will be charged in full.
- Please be advised that rejects raised, where the liability is considered to be that of the named supplier will incur a £ 250 + VAT administration fee.
- All costs associated with incorrectly supplied material will be charged in full to the material supplier.
- Suppliers must maintain all quality records required by their ISO 9001 certification ( relevant to Protocon orders ). Such records can only be removed after permission has been granted by Protocon Engineering QA department.
- Protocon Engineering, its customers, and regulatory authorities reserve the right of access to review processes and quality documentation at your works
Suppliers and Customers will:
- Notify Protocon of nonconforming product.
- Obtain Protocon approval for nonconforming product disposition.
- Notify Protocon of changes in product and/or process, change of suppliers, changes of manufacturing facility location and, where required, obtain Protocon approval.
- Establish ethical working behaviour, and practices and comply to all latest legal requirements, including, but not limited to;
Health and Safety at Work Act, Environmental Protection Act, COSHH Regulations, Duty of Care Regulations, Data Protection Act, Employment Act, Waste Regulations,
Export Control Act, UK Anti Bribery Act, Modern Slavery Act, Equal Opportunities Act.

Protocon shall not be liable for any default, delay or
failure to fulfil any obligation under any Contract which is due to any
circumstance beyond the reasonable control including, but not limited to, Acts
of God, war, civil unrest, riot, strike, lock-out, acts of civil or military
authorities, fire, flood, earthquake, epidemic, pandemic, or shortage of supply.
